Fall and Slip?
Property owners have a responsibility to maintain their property and keep conditions safe. When they fail to do so and someone gets hurt, property owners, management and anyone else responsible for the premises need to be held responsible and compensate you if you’ve sustained injury.
Slip and fall accidents – sidewalks, hallways and other walking areas used by the public must be kept free of obstacles and safe to walk on, no matter what time of year it is.
Ice & Snow - Property owners have a duty to ensure no “unnatural accumulation” of ice and snow causes a hazard to the public on their property.
Many property conditions cause an unnatural accumulation of ice and snow. For example, drains can back up, causing puddles of water to freeze, cracks and poorly maintained walkways, awnings and roofing can cause water to accumulate and freeze.
Patronizing a business? The owner is expected to correct known hazards and to inspect for unknown hazards.
If the hazard is open and obvious, you are expected to use reasonable care to avoid it. However, you are only expected to pay attention to where you are walking, not to walk with your head down and expect every hazard. Circumstances such as changes in lighting, ordinary conversation and loud noises can also be “reasonable distractions” that divert your attention from a hazard that the property owner should have addressed.

If you slip and fall, always get medical attention for any injuries.
If you are able, always take photographs of the condition that caused the fall.
Ask any responding employees or those around you to try to determine how long the condition or water spill existed. See if there are any cameras.
Do NOT give a statement. You do NOT have to give a statement to any managers or insurance agents. Often times insurance agents will twist your words from “not expecting” ice to “not paying attention,” from “being okay” and not needing an ambulance to “not hurt.”
